We may provide additional or different privacy policies that are specific to certain features, Services, or activities.

  • Location information, including general geographic location such as country, state or province, or city.
  • Content and information you elect to provide as part of your profile or in any communications you transmit through our Services.
  • Images, voice recordings, and videos collected or stored in connection with our Services, if you have consented to such information collection.
  • Identity document information, such as Social Security and driver's license numbers, if you have consented to such information collection.
  • Sensitive Personal Information
  • Some of the personal information we collect may be considered “sensitive personal information” under applicable state privacy laws. This includes identity document information such as Social Security numbers and driver’s license numbers. We collect sensitive personal information only when you voluntarily provide it and have consented to such collection. We use sensitive personal information only for the purposes disclosed at the time of collection or as otherwise permitted by law. You have the right to limit the use and disclosure of your sensitive personal information as described in the “WHAT ARE YOUR PRIVACY RIGHTS?” section below.

Information Automatically Collected

We automatically collect certain information when you visit, use, or navigate our Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies. We may use, and allow third parties to use, cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions. You can find out more about this in our Cookie Notice: https://www.prospect-hq.com/cookie-policy.

The information we may automatically collect includes:

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in our Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).
  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access our Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
  • Location Data. We collect location data such as information about your device's location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access our Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address).

HOW DO WE PROCESS YOUR INFORMATION?

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order.

  • To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services.
  • To send you marketing and promotional communications. We may process the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. You can opt out of our marketing emails at any time. For more information, see "WHAT ARE YOUR PRIVACY RIGHTS?" below.
  • To deliver targeted advertising to you. We may process your information to develop and display personalized content and advertising tailored to your interests, location, and more. For more information see our Cookie Notice: https://www.prospect-hq.com/cookie-policy.

  • To evaluate and improve our Services, products, marketing, and your experience. We may process your information when we believe it is necessary to identify usage trends, determine the effectiveness of our promotional campaigns, and to evaluate and improve our Services, products, marketing, and your experience.
  • To identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve them.
  • To determine the effectiveness of our marketing and promotional campaigns. We may process your information to better understand how to provide marketing and promotional campaigns that are most relevant to you.

  • For any other purpose with your consent.

WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

We do not sell your personal information for monetary consideration, but we may share your personal information with third parties in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.
  • Service Providers. We may share your information with contractors, service providers, and other third parties we use to support our organization and who are bound by contractual obligations to keep personal data confidential and use it only for the purposes for which we disclose it to them.
  • Business Partners. We may share your information with our business partners to offer you certain products, services, or promotions.
  • Other Users. When you share personal information or interact with our Services, such personal information may be viewed by all users and may be publicly made available outside our Services in perpetuity. If you interact with other users of our Services and register for our Services, your contacts on the social network will see your name, profile photo, and descriptions of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with you within our Services, and view your profile. When you disclose or direct us to disclose Private Profile Materials to recipients (such as Employers, Job Seekers, or recruiters), the recipient’s use of that information is governed by that recipient’s policies and notices, not by this Privacy Policy. Company does not control recipients’ independent use of information you choose to share with them and is not responsible for their acts or omissions.

If you submit a privacy-rights request concerning personal information that we have disclosed to an Employer, Job Seeker, recruiter, or other recipient, we can address the information maintained in our own systems. We may need to coordinate with the recipient regarding copies or other information it holds, and the recipient may need to respond to requests concerning its independent use or retention of that information under its own privacy policy and applicable law.

DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?

As part of our Services, we offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, "AI Features"). These AI-driven features are designed to help Job Seekers develop their professional profiles and career narratives, and to help Employers refine job descriptions and identify potentially relevant candidates. For a detailed description of how the AI Features work, the categories of data we use, our safeguards and bias mitigation measures, and your choices, please refer to the AI Notice.

HOW DO WE PROTECT AND RETAIN YOUR PERSONAL DATA?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access our Services within a secure environment. We are not responsible for circumvention of any privacy settings or security measures contained on our Services.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

DO WE COLLECT INFORMATION FROM MINORS?

International Data Transfers

Our Services are operated in the United States. If you are located outside of the United States, please be aware that any information you provide to us may be transferred to, stored, and processed in the United States or other countries where our service providers operate. By using our Services, you consent to the transfer of your information to the United States and other jurisdictions as described in this Privacy Policy. We take appropriate steps to ensure that your personal information receives an adequate level of protection in the jurisdictions in which we process it.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using our Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of our Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us at hello@prospect-hq.com.

WHAT ARE YOUR PRIVACY RIGHTS?

Depending on where you live, you may be able to control certain uses and disclosures of your information and may have certain rights under applicable state law.

Your Choices: Account, Marketing, Cookies, and Location.

Account Information. If you would at any time like to review or change the information in your account or terminate your account, you can log in to your account settings and update your user account. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Cookies and Other Tracking Technologies. You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. Some browsers include a "Do Not Track" (DNT) setting that can send a signal to the online services you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our Services may not respond to all browser DNT signals. Instead, you can use the range of other tools to control data collection and use, including the cookie controls and advertising controls described in this policy. Where supported, you may also use browser- or device-level settings, such as the Global Privacy Control (GPC) signal, and we will honor such signals as described in the “How to Exercise Your Rights” section below. For more information on how to control the collection of your information through tracking technologies, please refer to our Cookie Notice: https://www.prospect-hq.com/cookie-policy.

Marketing and Promotional Communications. You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, replying "STOP" or "UNSUBSCRIBE" to the SMS messages that we send, or by contacting us using the details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below. You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

Targeted Advertising by the Company. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our or our service providers' target audience preferences, you can opt out by contacting us at hello@prospect-hq.com or adjusting your account settings.

Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for their advertising and marketing purposes, you can opt out using the same methods — by contacting us at hello@prospect-hq.com or adjusting your account settings and preferences. We do not control third parties' collection or use of your information to serve interest-based advertising, but they may provide you with additional ways to limit such collection or use.

Location Data Choices. You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of our Services.

General Privacy Rights

Depending on your jurisdiction, you may have certain rights related to your personal information. Subject to applicable law and certain limitations and exceptions, these rights may include:

  • Access and Data Portability. You may confirm whether we process your personal information and access a copy of the personal information we process. To the extent feasible and required by applicable law, data will be provided in a portable format. Depending on your state, you may have the right to receive additional information and it will be included in the response to your access request.
  • Correction. You may request that we correct inaccuracies in your personal information that we maintain, taking into account the information's nature and processing purpose.
  • Deletion. You may request that we delete personal information about you that we maintain, subject to certain exceptions under applicable law.
  • AI Data-Use Choices. Where offered and subject to applicable law, you may opt out of certain uses of your personal information for model improvement or other similar secondary purposes, as described in the AI Notice, by using the available controls or contacting us through the rights-request channels described in the “How to Exercise Your Rights” section below. These choices do not disable AI processing that is integral to providing, operating, securing, or supporting the core Services. Because AI Features are integral to the Services, a complete opt-out from all AI processing is not available through account settings. Any rights relating to profiling or automated decision-making that apply under applicable law are described in the AI Notice.
  • Request an Explanation or Human Review. Where required by applicable law, you may request an explanation of the role of automated tools in significant decisions affecting you, the main parameters that materially influence the outcome, and human review of such decisions. We will reasonably explain the factors and data types that most influenced the result, subject to trade secret and security obligations. Job Seekers will be informed when automated tools are used to evaluate their applications and may request an alternative process by submitting a request as described in the “How to Exercise Your Rights” section below. If you believe an AI-driven outcome was incorrect or unfair, you may request human review through the same process. Individuals with disabilities may request reasonable accommodations in connection with AI Features by emailing us at hello@prospect-hq.com or through our accessibility support channels.

Additional Privacy Rights for Residents of Certain U.S. States

In addition to the General Privacy Rights described above, residents of certain U.S. states, including but not limited to California, Virginia, Colorado, Connecticut, Utah, and other states with comprehensive privacy laws, may have additional or more specific rights regarding their personal information under applicable state privacy laws. Depending on your state of residence, these rights may include:

  • The right to know what personal information we collect, use, disclose, and sell or share.
  • The right to request deletion of your personal information, subject to certain exceptions.
  • The right to opt out of the sale or sharing of your personal information, targeted advertising, or profiling in furtherance of decisions that produce legal or similarly significant effects.
  • The right to limit the use and disclosure of your Sensitive Personal Information for certain purposes, subject to applicable law, as described in the Sensitive Personal Information section above and in this section.
  • The right to correct inaccurate personal information.
  • The right to non-discrimination for exercising your privacy rights.
  • To exercise these rights, please submit a request through the methods described in the “How to Exercise Your Rights” section below. We will verify your identity and respond to your request within the time frame required by applicable law, as described in the “Request Verification” section.
  • We do not sell personal information for monetary consideration. We may share personal information with third parties for purposes described in this Privacy Policy, which may be considered a “sale” or “sharing” under certain state laws. You may opt out of such sharing by contacting us or adjusting your account settings as described above.

How to Exercise Your Rights

To exercise these rights, you can contact us by submitting a data subject access request, by emailing us at hello@prospect-hq.com, or by referring to the contact details at the bottom of this document.

We will honor your opt-out preferences if you enact the Global Privacy Control (GPC) opt-out signal on your browser, consistent with the description in the “Cookies and Other Tracking Technologies” subsection above.

Under certain data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.

Request Verification

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.

If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide written and signed permission from you to submit such request on your behalf.

Appeals

Under certain data protection laws, if we decline to take action on your request, you may appeal that decision by emailing us at hello@prospect-hq.com. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decision. If your appeal is denied, you may submit a complaint to your state attorney general.

DO WE MAKE UPDATES TO THIS NOTICE?

We may update this Privacy Policy from time to time to reflect changes in features, data practices, safeguards, or legal requirements. The updated version will be indicated by an updated "Revised" date at the top of this Privacy Policy. If we make material changes to this Privacy Policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification, consistent with our Terms of Service. We encourage you to review this Privacy Policy frequently to be informed of how we are protecting your information. Prior versions are retained for reference where required.
